Terms of Service

1. Acceptance

By accessing or using Cossmic (the "Service"), operated by DAKSHINAVARTI TECHNOLOGIES LLP("we", "us"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Cossmic is a cloud-based applicant tracking, recruiting, and onboarding platform for businesses in India. Features include job postings, candidate management, interview scheduling, offer management, and employee onboarding.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate registration information.
• You are responsible for all activity under your account.
• You must not share access credentials with unauthorized parties.

4. Acceptable Use

You agree not to:

• Use the Service for unlawful hiring discrimination.
• Upload malicious files, viruses, or harmful code.
• Attempt to access data of other organizations on the platform.
• Reverse-engineer, decompile, or resell the Service.
• Violate any applicable Indian law, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

5. Data Ownership & Processing

You retain ownership of all data you upload to Cossmic, including candidate data, job descriptions, and documents. You grant Cossmic a limited license to store and process this data solely to provide the Service. Where Cossmic processes personal data on your behalf, that processing is governed by our Data Processing Agreement, available to every paid customer. How we handle personal data is described in our Privacy Policy.

6. Billing & Payment

• Subscription fees are billed in advance on a monthly or annual basis in INR.
• All payments are processed via Razorpay. GST is applied per Indian tax law.
• 14-day free trial — no credit card required. Upgrade to continue after the trial ends.
• Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current plan price, unless you cancel before the period ends. You authorise Cossmic, via Razorpay, to charge your saved payment method for each renewal.
• Pre-debit notice. In line with RBI rules for recurring payments, you receive a notification at least 24 hours before each automatic charge, so you can review or cancel it in advance.
• Price changes.We may change plan prices with at least 30 days' notice before your next renewal. Any new price applies only from your next renewal after that notice — never mid-period — and you may cancel before it takes effect.
• Cancellations take effect at the end of the current billing period. No partial refunds. Full details are in our Refund & Cancellation Policy.

7. Service Availability

We target 99.5% monthly uptime. Scheduled maintenance is performed during off-peak hours. We are not liable for downtime caused by third-party providers (see our subprocessor list).

8. Limitation of Liability

To the maximum extent permitted by applicable law, Cossmic's total liability for any claim arising from use of the Service is limited to the fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Cancellation & Termination

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain full access until then. We reserve the right to suspend accounts that violate these Terms immediately and without notice. Upon termination, account data is retained for 90 days then permanently deleted, subject to any statutory retention obligations described in our Data Retention Policy.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from use of the Service will be resolved in accordance with Indian law.
